The Bribery Act & FCPA ...
The Foreign Corrupt Practices Act (FCPA) and The UK Bribery Act are significant pieces of legislation, with severe penalties for individuals or organisations found to be in breach of these Acts.
The legislation is far-reaching, and designed to send out a clear signal to business leaders that governments are serious about the problem, and payment of bribes and / or 'sweeteners' is no longer acceptable, even where it might have once been the norm or common practice.
While failure to comply can result in significant penalties, the legislation does attempt to support organisations which have tried to prevent the illegal acts of bribery. For example, organisations which have processes and systems (training and risk management plans) to monitor employees and consultants will be given consideration.
Maegus can assist clients by ensuring that key legislative criteria are met. For capital projects, which have been identified as being of particularly high risk, it can provide the reassurance and oversight for compliance.
